statutory beneficiary of an insured decedent can recover under
the uninsured/underinsured provisions of the decedent's
insurance policy even if the wrongful death claimant is not a

- In re Amtrak "Sunset Limited"
Train Crash. The crash, which caused forty deaths in 1993,
happened because the skipper of a river vessel took a wrong turn
and damaged a railroad bridge. District Court held that Alabama
law prevailed over maritime law in ensuing wrongful death
actions. Defendants appealed. Eleventh Circuit vacated and

In Minnesota, "Recovery as 'next
of kin' under the wrongful death statute is limited to blood
relatives of the decedent who have suffered compensable loss,
but is not governed by the law of intestate succession.
Therefore, there is no legal impediment to recovery under the

In Maryland, "pecuniary and
solatium damages are recoverable for the death of an unmarried
child who is not a minor child if the child is 21 years old or
younger or a parent contributed 50% or more of the child's

also recoverable for the death of the parent of an adult
